We recently achieved a $750,000 settlement for a special needs middle school student who was placed in an improper restraint hold by a teacher. The client was involved in an altercation with another student when teachers separated them and one of the teachers placed our client into an improper and excessive restraint hold against a hallway wall for more than a minute. The restraint hold used by the teacher was a joint-lock technique commonly used as a submission technique in mixed martial arts and to subdue/control resisting suspects by police officers. The teacher's inappropriate use of this restraint hold broke the client's arm. Unfortunately, the school failed to fire or even discipline the teacher after the assault. We filed a lawsuit against the school which ultimately resulted in the teacher being fired and the school agreeing to a $750,000 settlement.
